TERMS OF SALES

1. PUBLISHING COMPANY

LE DOMAINE DU TERROIR, hereinafter referred to as “the Hotel”

2. PURPOSE

These conditions of sale are applicable to all reservations made privately in the hotel Le Domaine du Terroir. The offers offered are exclusively reserved for individuals.

3. DURATION

These general conditions of sale apply for the entire duration of the online offers by the Hotel, which reserves the right to temporarily or permanently close its website, or the online booking space, without notice or indemnity. In this event, it cannot be held liable for damages of any kind that may result for the Customer, the same in the event of modification of the offers and/or temporary unavailability or even the definitive closure of all or part of of the site or the services associated with it.  

  4. RESERVATION

Prior to any reservation, the Customer declares to have full legal capacity to commit.

In order to be able to benefit from the legal protective provisions of consumer law, the Customer must expressly declare that the reservation is intended for him personally.

The Customer also acknowledges having read and accepted without reservation and in their entirety these general conditions of sale on the Internet.

Finally, he acknowledges having read the nature, destination and booking methods of the services offered on the website, and, where applicable, having requested and obtained all the information he deemed necessary to make his booking in full knowledge. of cause.

The Customer is solely responsible for his choices and their suitability for his needs, and the Hotel declines in advance any liability in the event of damage or litigation on this account.

The purchase by the customer is considered definitively made at the end of the reservation process.

5. RESERVATION PROCESS

Prior to any reservation made online on the website, the Customer undertakes to fill in the information requests appearing on the voucher or the reservation request.

The reservation is deemed to have been made upon receipt by the Hotel of the reservation voucher or the Customer's reservation request, or during online prepayment by credit card.

The Customer certifies the truthfulness and accuracy of the information he provides to the Hotel.

The reservation procedure includes the following steps:

Step 1: selection, if applicable, of one or more additional services;
Step 2: verification of the details of the reservation, its total price, the applicable sales conditions and any adjustment of the choice (room, price, additional service), in the case of online reservation only;
Step 3: providing the customer's contact details;
Step 4: consultation and acceptance of the general conditions of sale and the conditions of sale of the reserved rate;
Step 5: validation of the reservation by the customer.


6. ACKNOWLEDGMENT OF RECEIPT OF RESERVATION

An acknowledgment of receipt is sent to the customer by e-mail, once his reservation has been registered, which summarizes the offer, the services purchased, the prices, the conditions of sale relating to the selected rate accepted by the customer, the information relating to the service after-sales service and commercial guarantees, as well as the address of the Partouche group establishment to which the customer can submit complaints.

7. CUSTOMER SERVICE

For any complaint relating to a hotel reservation, the Hotel's reservation service is available to the Customer from Monday to Saturday from 8 a.m. to 6.30 p.m. (French time) at the following telephone number: (+33) 5.53.51.04.17.

The Customer is reminded that in accordance with the provisions of Article L. 121-20-4 of the Consumer Code, he does not have the right of withdrawal provided for in Article L. 121-20 of the Consumer Code. .

8.  MODIFICATION - CANCELLATION

The conditions of sale at the reserved rate specify the terms of cancellation and/or modification of the reservation.

Reservations requiring prepayment cannot be modified and/or canceled.

The sums paid in advance constitute a deposit which cannot be refunded.

In this case, it is mentioned in the conditions of sale at the reserved rate.

When the conditions of sale at the reserved rate allow it:

- the cancellation of the reservation can be made directly on the site http://www.ledomaineduterroir.fr, or on the site of the Hotel in the section

“Modify or cancel your reservation”.

In the event of interruption of the stay, the entire agreed price will be due and collected.

9. HOTEL STAY

Unless expressly provided otherwise, the Client's arrival at the Hotel is at 4 p.m., and the room must be vacated at the end of the stay by 11 a.m. at the latest. Otherwise, an additional night will be charged.

In application of the regulations in force in France, the Customer must present an identity document in order to verify whether or not he must complete a police form.

The Customer undertakes to use the room as a good father.

Any behavior contrary to morality and public order will lead the hotelier to ask the Customer to leave the establishment without being able to claim any refund or payment of compensation if a payment has already been made.

The Hotel offers its Customers free WIFI access.

The Customer agrees that the computer resources made available to him by the Hotel will not be used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects. protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Code of intellectual property where such permission is required. The Customer is required to comply with the security policy of the Hotel's internet service provider, including the rules for using the means of security implemented in order to prevent the illicit use of computer resources [ or other name used in the company's IT charter], and to refrain from any act that undermines the effectiveness of these means. If the Customer does not comply with the aforementioned obligations, he could be accused of an offense of counterfeiting (article L.335-3 of the intellectual property code), punishable by a fine of 300,000 euros and three years' imprisonment. .

10. WARRANTIES

In accordance with the provisions of Articles L. 212-1 and following of the Consumer Code, the Hotel is required to guarantee the Customer the conformity of the services it offers, which, under normal conditions of use or in other conditions reasonably foreseeable by the professional, must present the security that can legitimately be expected and must not harm the health of persons.

 

11. LIABILITY

The Hotel cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, act of a third party, act of the Customer or act of its partners, such as unavailability of the Internet network, impossibility access to the website, external intrusion, computer viruses or in the event of prepayment not authorized by the bearer's bank.

Furthermore, the Hotel cannot be held liable for any consequential damages suffered by the Customer in respect of his reservation.

The photographs presented on the site are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and the texts reproduced to illustrate the hotels presented give as accurate an overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture. or possible renovations. The customer cannot claim any claim from this fact.

Hypertext links may refer to sites other than the http://www.ledomaineduterroir.fr site, and the Hotel accepts no responsibility for the content of these sites and the services they offer.

Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the latter.

 

12. COMPLAINTS

Complaints relating to the poor execution of hotel services, or their non-execution must, under penalty of foreclosure, be brought to the attention of the reservation department of the Hotel within 24 hours of arrival at the Hotel by mail addressed to the address indicated above in article 1

 

13. PRICES

The price of the services is indicated to the Customer on the site and when booking.

The prices indicated are per room for the number of person(s) and the date(s) selected by the customer.

The rates applied are confirmed to the customer including tax, in euros, and are only valid for the duration indicated on the site.

If payment at the hotel is made in a currency other than that provided for in the reservation, the exchange costs are the responsibility of the customer.

All orders, regardless of their origin, are payable in the hotel's local currency, unless special provisions are indicated on site.

Unless otherwise stated and special themed boxes, additional services such as: breakfast, half board, full board... (without this list being exhaustive) are not included in the price.

The tourist tax, provided for each rate, is to be paid directly on site to the Hotel.

The prices take into account the VAT at the rate in force on the day of the order and any change in said rate will be automatically passed on to the prices indicated on the date of invoicing.

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be passed on to the prices indicated on the date of invoicing.

If a rate implies that the payment is made at the hotel at the time of arrival or departure, and that the Customer's currency is not the same as that of the hotel, the payment  debited by the hotel is likely to be different from the price communicated to the Customer  when booking, taking into account the possible evolution of exchange rates between the date of booking and the dates of stay at the hotel.

The Hotel informs the Customer of the total amount of his order in the confirmation e-mail sent to him.

 

14. PAYMENT

The Customer must communicate directly, in the area provided for this purpose (secure entry by SSL encryption), the credit or private bank card number (Visa, Mastercard, American Express, etc.) without spaces between the numbers, as well as its date. of validity, in order to guarantee its reservation except conditions or special tariffs, by indicating

The debit of the payment is made at the hotel at the end of the stay, except in the case where special conditions or rates have been applied or when the debit of the payment has been made during the reservation (online prepayment on certain rates ).

This prepayment is called a deposit.

In the event of a reservation without online prepayment, the Hotel may ask the Customer, upon arrival, for a security deposit or authorization to debit their credit card, in order to guarantee payment of any additional services requested on site by the Customer.

In case of no show (reservation not canceled - customer not present) of a reservation whose payment is guaranteed by credit card, the hotel will collect by means of the credit card, whose details are given by the Customer as a guarantee of his reservation, a fixed compensation equal to the price of the first night.

In the event that the customer reserves several rooms but prepayment is only necessary for one, for example, the payment card used when booking will serve as a guarantee for the payment of the other rooms and/or supplements.

During prepayment, the amount debited to the Customer includes: the price of accommodation, taxes related to accommodation, the price of catering if breakfast is provided, as well as taxes related to catering and all other services additional items selected by the Customer.

In the case of a reservation subject to online prepayment, the sums paid are then deposits, which are debited at the time of the reservation and remain with the Hotel.

15. RESPECT OF PRIVACY

The personal information requested from the Customer when booking is necessary to process his order. If not provided, the booking request cannot be recorded.

The Customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of his answers by the presence of an asterisk.

The Customer is informed that all of the personal data collected is subject to automated processing. The Hotel declares its processing to the Commission Nationale Informatique et Libertés (CNIL).

The processing of this data enables the Hotel to fulfill its obligations vis-à-vis the Customer and to inform him of special offers and any new services put in place by the Hotel.

The Customer has the right to oppose, free of charge, that the data concerning him are used for prospecting purposes, in particular commercial. Furthermore, by clicking on the unsubscribe link at the bottom of each commercial email, the Customer may unsubscribe at any time.

In accordance with the Data Protection Act of January 6, 1978, the Customer has a right of access, rectification and opposition to his personal data. All they have to do is write to the postal address of the Hotel, provided at the top of this document, indicating their surname, first name, e-mail address and, if possible, their customer reference. In accordance with the regulations in force, this request must be signed by the Customer, be accompanied by a photocopy of an identity document bearing his signature and specify the address to which he must receive the answer which will then be sent to him in a 2 months following receipt of the request.

The Customer who makes a hotel reservation on the site http://www.ledomaineduterroir.fr, authorizes the Hotel to communicate his personal data to third parties on the condition that such communication proves to be compatible with the performance of the services which he are incumbent, and unless opposed by him, the Customer is likely to receive by e-mail,  a satisfaction questionnaire following their stay, the “newsletter” (newsletter) from the Hotel or from one of the hotels in the Partouche Hotels group, and promotional offers.

 

16. CONVENTION OF PROOF

The entry of the required banking information, as well as the acceptance of these general conditions and the voucher or the reservation request, constitute an electronic signature which has, between the parties, the same value as a handwritten signature.

The computerized registers kept in the Hotel's computer systems will be kept under reasonable security conditions and considered as proof of communications, orders and payments between the parties.

The Customer is informed that his IP address is registered at the time of booking.

 

17. REMOVAL

In the event of the Hotel's unavailability or in the event of force majeure, the latter reserves the right to have the Customer accommodated in whole or in part in a hotel of equivalent category for services of the same nature. All of the costs involved in the transfer remain the responsibility of the Hotel, whose liability for the payment of any additional compensation cannot be sought on this account.

 

18. FORCE MAJEURE

The Hotel cannot be held liable to the Customer for any damage whatsoever, in the event of non-performance of its obligations resulting from force majeure. Are considered as cases of force majeure or fortuitous event those usually recognized by the jurisprudence of the French Courts and Tribunals.

 

19. ENTIRETY

These general conditions of sale, conditions of sale of the rate reserved by the Customer, and the voucher or the reservation request express the entirety of the obligations of the parties.

No general or specific condition desired by the Customer may be incorporated into these general conditions.

The documents forming the contractual commitments between the parties are, in descending order of priority, the voucher or the reservation request (including the special conditions of the reserved rate) and these general conditions.

In the event of a contradiction between the booking form and the general conditions, the provisions appearing on the booking form will be the only ones applicable to determine the obligation in question.

 

20. EVOLUTION / MODIFICATION OF THE GENERAL CONDITIONS OF SALE ON THE INTERNET

These General Terms and Conditions of Internet Sale may be modified and/or supplemented by the Hotel at any time. In this case, the new version of the General Conditions of Internet Sale will be posted on the Hotel's website. As soon as it is put online, the new version of the General Conditions of Sale by Internet will automatically apply to all customers who must also consult the additional conditions of sale linked to each rate, type of room or type of service, appearing on the list. tariffs.

 

21. APPLICABLE LAW - DISPUTES

These General Conditions of Sale are governed by French law. This is the case for the rules of substance as well as for the rules of form.

In the event of a dispute between the parties which could not be resolved amicably, the Courts of Paris will have sole jurisdiction.
